These terms apply to all users, including clients, prospective clients, and website visitors. We reserve the right to modify these terms at any time, and continued use of our services constitutes acceptance of any changes.

Section 2

Services Provided

Drone Services North East provides professional drone operations including:

  • Aerial Data & Reporting: Surveying, mapping, and data capture with professional processing and reporting
  • Construction Monitoring: Progress tracking, volume calculations, and site documentation
  • Inspections & Asset Monitoring: Roof, façade, infrastructure, and industrial asset inspections
  • Surveying & Mapping: Topographic surveys, corridor surveys, and boundary mapping
  • Offshore & Renewable Energy: Wind turbine inspections, platform surveys, and offshore operations
  • Media & Promotional Content: Aerial photography, video production, and marketing content

All services are subject to site suitability assessment, weather conditions, regulatory permissions, and contractual agreement. We reserve the right to decline projects that do not meet safety, legal, or operational requirements.

Section 3

Website Use

You may use our website for lawful purposes only. You agree not to:

  • Use the website in any way that violates applicable laws or regulations
  • Attempt to gain unauthorized access to our systems, servers, or networks
  • Introduce viruses, malware, or other harmful code
  • Scrape, copy, or replicate website content without permission
  • Use automated systems (bots, scrapers) to access the website
  • Impersonate any person or entity or misrepresent your affiliation

We reserve the right to suspend or terminate access to our website for any user who violates these terms.

Section 4

Booking & Engagement Process

Consultation & Quote

All projects begin with an initial consultation to discuss requirements, site conditions, and deliverables. Following consultation, we provide a fixed-price quote outlining:

  • Scope of work and deliverables
  • Project timeline and deployment dates
  • Pricing breakdown and payment terms
  • Any site-specific requirements or constraints

Contract Formation

A binding contract is formed when:

  • You accept our written quote (via email, signed document, or purchase order)
  • Payment of the deposit (if required) is received
  • We send written confirmation of project commencement

Quotes are valid for 30 days from the date of issue. Pricing may be subject to change if site conditions, scope, or requirements change significantly.

Section 5

Payment Terms

Standard Payment Structure

  • New Clients: 50% deposit on project confirmation, 50% balance on deliverables handover
  • Established Clients: Net 30 days from invoice date (subject to credit approval)
  • Large Projects: Staged payments may be agreed based on project milestones

Accepted Payment Methods

We accept payment via bank transfer (BACS), credit/debit card, or company purchase order (for established clients). Payment details are provided on invoices.

Late Payment

Late payments may incur interest charges at a rate of 8% above the Bank of England base rate, as permitted under the Late Payment of Commercial Debts (Interest) Act 1998. Deliverables may be withheld until full payment is received.

Payment Disputes

If you dispute any invoice, you must notify us in writing within 7 days of receipt, specifying the disputed amount and reasons. Undisputed amounts remain payable on the original due date.

Section 6

Cancellations & Rescheduling

Client Cancellations

  • More than 48 hours before deployment: Full refund of deposit (if paid)
  • Less than 48 hours before deployment: 50% cancellation fee applied
  • Same-day cancellation or no-show: 100% cancellation fee applied

Weather Cancellations

If weather conditions prevent safe operations, we will reschedule at no additional cost. Weather-related cancellations do not incur fees. We monitor forecasts closely and provide as much advance notice as possible.

Rescheduling by Drone Services North East

If we need to reschedule due to equipment failure, regulatory issues, or unforeseen circumstances, we will provide alternative dates at no additional cost. If alternative dates cannot be agreed, a full refund will be provided.

Section 7

Deliverables & Data Ownership

Ownership of Deliverables

Upon full payment, you own all processed deliverables (reports, orthomosaics, point clouds, imagery, etc.) for your internal use. Raw data (unprocessed images, flight logs) remains the property of Drone Services North East unless otherwise agreed.

Permitted Use

You may use deliverables for:

  • Internal project planning, analysis, and decision-making
  • Sharing with contractors, consultants, or stakeholders directly involved in the project
  • Regulatory submissions, planning applications, or compliance documentation

Restrictions

You may not:

  • Resell, license, or commercialize deliverables without written permission
  • Use deliverables for purposes unrelated to the original project scope
  • Remove metadata, watermarks, or attribution (where applicable)
  • Claim authorship or creation of the deliverables
Portfolio & Marketing Use

We reserve the right to use project imagery and data (anonymized where necessary) for portfolio, marketing, and case study purposes unless you request confidentiality in writing. Sensitive or confidential projects will not be used without explicit permission.

Section 8

Intellectual Property

All content on our website — including text, images, graphics, logos, videos, and software — is the property of Drone Services North East or our licensors and is protected by UK and international copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our website content without prior written permission. Limited use for personal, non-commercial reference is permitted (e.g., saving a page for offline reading).

Section 9

Liability & Disclaimers

Service Limitations

While we strive to deliver high-quality, accurate services, aerial data and inspections have inherent limitations:

  • Accuracy is subject to ground control quality, weather conditions, and site characteristics
  • Visual inspections may not detect internal defects, hidden damage, or subsurface issues
  • Reports are based on observable conditions at the time of survey and do not predict future deterioration
  • We provide technical data and observations — not engineering design, structural calculations, or legal advice

Limitation of Liability

To the fullest extent permitted by law, Drone Services North East's liability for any claim arising from our services is limited to the total fees paid for the specific project. We are not liable for:

  • Indirect, consequential, or incidental damages
  • Loss of profits, revenue, business opportunities, or data
  • Decisions made based on our reports or data
  • Third-party claims arising from your use of deliverables

Insurance

We maintain £10M Public Liability Insurance and Professional Indemnity Insurance. Insurance certificates are available on request.

Professional Advice Disclaimer

Our services provide technical data and visual observations. We do not provide engineering design, structural calculations, legal advice, or certified surveying services unless explicitly stated. Always consult qualified professionals (structural engineers, surveyors, legal advisors) for design, compliance, and decision-making purposes.

Section 10

Site Access & Safety

Client Responsibilities

You are responsible for:

  • Providing safe, legal access to the site
  • Informing us of all hazards, restrictions, and site-specific safety requirements
  • Obtaining necessary permissions from landowners, tenants, or authorities
  • Coordinating with site teams, contractors, or security personnel
  • Ensuring exclusion zones can be maintained during operations

Our Responsibilities

We will:

  • Prepare site-specific Risk Assessments and Method Statements (RAMS)
  • Operate in compliance with CAA regulations and safety protocols
  • Coordinate with site management and conduct safety briefings
  • Maintain appropriate insurance and certifications

If site conditions are found to be unsafe or significantly different from those described, we reserve the right to suspend operations until hazards are resolved. Additional fees may apply if significant changes to scope or safety measures are required.

Section 11

Confidentiality

We treat all client information, project details, and deliverables as confidential unless:

  • Information is publicly available or becomes public through no fault of ours
  • Disclosure is required by law, court order, or regulatory authority
  • You provide written permission for specific use (e.g., portfolio, case studies)

If your project involves commercially sensitive or security-critical information, please inform us in writing so we can implement additional confidentiality measures.

Section 12

Force Majeure

Neither party shall be liable for failure to perform obligations due to events beyond reasonable control, including:

  • Severe weather, natural disasters, or acts of God
  • War, terrorism, civil unrest, or government restrictions
  • Pandemics, epidemics, or public health emergencies
  • Equipment failure, power outages, or technology disruptions
  • Regulatory changes affecting drone operations

In such cases, we will make reasonable efforts to reschedule or provide alternative solutions. If performance becomes impossible, either party may terminate the contract with a pro-rata refund for work not completed.

Section 13

Dispute Resolution

If a dispute arises, both parties agree to:

  • Step 1: Direct Discussion — Attempt to resolve the issue through good-faith negotiation
  • Step 2: Mediation — If unresolved, engage in formal mediation with a neutral third party
  • Step 3: Legal Action — As a last resort, disputes will be resolved under the laws of England and Wales, with jurisdiction in UK courts

Both parties agree to act reasonably and in good faith to resolve disputes without unnecessary delay or expense.

Section 14

Governing Law

These Terms of Use are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

If any provision of these terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.

Section 15

Changes to These Terms

We reserve the right to modify these Terms of Use at any time. Changes will be communicated via:

  • A prominent notice on our website
  • Email notification to active clients (for material changes)
  • Updated "Last Updated" date at the top of this page

Continued use of our website or services after changes take effect constitutes acceptance of the updated terms. Existing contracts in progress remain subject to the terms agreed at the time of contract formation.
